Oakville Man Fires Shots to Scare Away Woman's Ex-Boyfriend, Police Say

Garry Phillips told police the ex-boyfriend was kicking the woman's apartment door trying to gain entry, and had threatened him.

A man is accused of firing two shots in the air at a Wentzville apartment complex in attempt to scare away another man June 20.

Garry L. Phillips, 24, of the 5700 block of Flaming Leaf Court in Oakville, was charged Monday in St. Charles County Circuit Court with unlawful use of a weapon by an intoxicated person.

Wentzville Police said Phillips was at an apartment in the 5100 block of Peine Lakes Drive in Wentzville with a woman when her ex-boyfriend arrived. The man knocked on the door for several minutes, and the woman told him he could not come in, police said.

Phillips told police the man began kicking the door, which began buckling in, and yelled that he would kill Phillips. The man told police he did not threaten Phillips.

Phillips then grabbed his .40 cal handgun, walked onto the third-story balcony and fired a shot into the air. When Smith yelled, “Come on,” Phillips fired a second shot, according to a police statement. Phillips told police he saw the man below the balcony, and fired the shots in attempt to scare him away.

Phillips told police he had never met the man before, and he had only met the woman a few hours before. He said they had been drinking alcohol throughout the day.

A breath sample two hours after the incident showed Phillips’ blood-alcohol content was 0.08 percent.

Phillips posted a $2,500 bond on Monday and was released from jail.
